Terms and Conditions

1. Acceptance of Terms
By accessing or using SikaMart ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform. SikaMart is operated under the laws of the Republic of Ghana.
2. Platform Overview
SikaMart is an online marketplace that connects verified vendors with buyers across Ghana. The Platform facilitates discovery and contact between buyers and sellers but does not directly process or guarantee transactions. All purchases are conducted directly between buyers and vendors via WhatsApp.
3. Vendor Registration
Vendors must provide accurate personal information including full name, shop name, valid Ghana phone number (+233 format), and a live selfie for identity verification. False information will result in immediate account termination. Vendors must be at least 18 years old or have parental consent.
4. Prohibited Items
The following items are strictly prohibited on SikaMart: weapons, firearms and ammunition, illegal drugs and controlled substances, adult content and pornographic material, counterfeit or stolen goods, alcohol sold to minors, human trafficking or exploitation services, any item illegal under Ghanaian law, and any item that violates third-party intellectual property rights.
5. Vendor Responsibilities
Vendors are solely responsible for the accuracy of their listings, the quality and condition of items sold, honouring agreed prices and delivery, responding to buyer inquiries promptly, and complying with all applicable Ghanaian laws regarding commerce and taxation.
6. Subscription and Payments
Vendors on the Power Vendor Plan pay GHS 35 per month. Casual vendors pay GHS 5 per listing. All payments are processed via Paystack in Ghana Cedis. Subscription fees are non-refundable. A 7-day free trial is offered to all new approved vendors. Failure to renew results in a 48-hour grace period followed by account suspension.
7. Buyer Protection
SikaMart verifies vendor identities through live selfie capture. However, SikaMart does not guarantee the quality, safety, or legality of listed items. Buyers are encouraged to exercise due diligence before purchasing. Reports of fraudulent vendors are investigated within 24 hours and may result in account termination.
8. Reporting and Enforcement
Any user may report suspicious listings or vendors using the Report button. SikaMart reserves the right to remove any listing or ban any vendor that violates these Terms without prior notice. Repeated violations may result in permanent account termination and legal action where applicable.
9. Privacy and Data
SikaMart collects vendor name, email, phone number, and selfie for identity verification purposes only. Vendor selfies are stored securely and are never displayed publicly. Only store logos are shown publicly. SikaMart does not sell user data to third parties. By using the Platform, you consent to the collection of this information.
10. Intellectual Property
The SikaMart brand, logo, platform design, and codebase are the exclusive property of SikaMart Ghana. Vendors retain ownership of their product images and descriptions. By uploading content to SikaMart, vendors grant SikaMart a non-exclusive licence to display that content on the Platform.
11. Limitation of Liability
SikaMart is not liable for any direct, indirect, or consequential losses arising from transactions conducted between buyers and vendors. SikaMart is a discovery and connection platform only. All disputes between buyers and vendors must be resolved directly between the parties.
12. Amendments
SikaMart reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Material changes will be communicated via SMS or email to registered vendors.
13. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms shall be subject to the jurisdiction of Ghanaian courts.
